Draft LEP Amendment No.36 & Proposed Planning Agreement - Great Lakes Council and Davglade Pty Ltd
The proposed Planning Agreement between Great Lakes Council & Davglade Pty Ltd and Draft Great Lakes LEP (Amendment No.36) were exhibited concurrently for thirty-one (31) days from 18 November - 18 December 2009.
Notice of public exhibition was given of an amendment to the proposed Planning Agreement between Great Lakes Council and Davglade Pty Ltd (previously adopted by Council on 21 October 2008), pursuant to section 93G of the New South Wales Environmental Planning and Assessment Act 1979. Council accepted an offer by Davglade Pty Ltd to enter into a Planning Agreement in connection with draft Great Lakes Local Environmental Plan 1996 - Amendment No. 36 (DLEP36) to facilitate the following outcomes:
- Dedication of the land proposed to be zoned '6(a) Open Space & Recreation' (approx. 9ha) within a specified timeframe following gazettal of DLEP36;
- Recognition of Section 94 credit (at a future DA stage) for the 2000m2 Neighbourhood Park that forms part of the dedicated land referred to above; and
- Enforceability of obligations through the Environmental Planning and Assessment Act.
Notice of public exhibition was also given pursuant to section 66 of the Environmental Planning and Assessment Act 1979 of draft Great Lakes Local Environmental Plan 1996 - Amendment No. 36. The amended plan (DLEP36) aims to rezone land to which the proposed Planning Agreement (PA) applies generally from Zone No. 1(c) (Future Urban Investigation Zone) to Zone No. 2(a) (Low Density Residential Zone) and Zone No. 6(a) (Open Space and Recreation Zone). The subject land to which DLEP36 applies is that part of Lot 6177 DP 1099599 situated east of The Southern Parkway, South Forster.
Although Council had previously adopted DLEP36 and the corresponding Planning Agreement for this land, further amendments to these statutory planning documents have been made to:
- reflect changes in corresponding legislation;
- reflect updated zoning advice from NSW Rural Fire Service regarding land at the end of Oriana Close; and
- ensure timing for dedication of the proposed 6(a) land to Council is better integrated with the development application process under Part 3A of the EP&A Act.
The final DLEP 36 and the related PA were adopted by Council on 9 March 2010 but have yet to be gazetted by the Minister.
